These Terms and Conditions (“Terms”) govern your access to and use of the Queen Essentials website (www.queenessentials.us), mobile applications, and any purchases made through our platform (collectively, the “Site”). By accessing the Site, browsing, creating an account, or purchasing our products, you agree to be bound by these Terms, as well as our Privacy Policy and any additional terms and policies referenced herein.

“Queen Essentials,” “we,” “us,” or “our” refers to the owner and operator of the Site, Queen Essentials LLC, including its affiliates and subsidiaries. “You,” “your,” or “Customer” refers to the individual accessing or using the Site or purchasing products. “Products” refers to all hair care items and related goods sold on the Site.

2. Account Registration

2.1 You may browse our Site without registering, but you must create an account to make purchases or access certain features.
2.2 You agree to provide accurate, complete, and up-to-date information when registering for an account and to update your information as needed.
2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Queen Essentials is not liable for unauthorized use of your account.

3. Products and Pricing

3.1 Product descriptions, images, and prices are subject to change without notice. We strive for accuracy but do not guarantee that all information is error-free. Colors may vary based on display settings.
3.2 All prices are displayed in U.S. dollars unless stated otherwise and may or may not include applicable taxes, which will be calculated at checkout.
3.3 We reserve the right to limit product quantities, discontinue products, and refuse orders at our sole discretion.

4. Orders and Payment

4.1 All orders are subject to acceptance and product availability.
4.2 We accept payment through authorized third-party processors. By submitting your payment information, you represent and warrant that it is accurate and that you are authorized to use the payment method.
4.3 You will receive an order confirmation via email upon successful checkout. This email confirms receipt of your order but does not constitute acceptance.
4.4 We reserve the right to cancel or refuse any order for any reason, including errors in product availability or pricing.

5. Shipping and Delivery

5.1 Shipping fees and estimated delivery times are calculated at checkout and vary depending on your location and selected shipping method.
5.2 Queen Essentials is not liable for shipping delays caused by carriers, customs, or other events outside our control.
5.3 Title and risk of loss for Products pass to you upon our delivery to the carrier.
5.4 Please ensure shipping information is accurate; we are not responsible for lost or delayed shipments due to incorrect addresses.

6. Returns, Exchanges, and Refunds

6.1 You may return unopened, unused products in their original packaging within 30 days of delivery for a refund or exchange.
6.2 Items must be in new, resalable condition. We do not accept returns for used products, sale items, or personal care items that have been opened unless defective.
6.3 Return shipping costs are the responsibility of the customer unless the item is defective or sent in error.
6.4 Refunds will be issued to the original payment method within 5–7 business days after we receive and inspect the returned item.

7. Product Warranty

7.1 Queen Essentials warrants that our Products are free from material and workmanship defects for 90 days from the date of purchase.
7.2 This warranty does not cover misuse, negligence, accidents, or failure to follow product instructions.
7.3 If a Product is defective, we may offer a replacement or refund at our discretion. Proof of purchase may be required.

8. Intellectual Property

8.1 All content on the Site, including text, graphics, logos, icons, images, videos, product descriptions, and software, is the exclusive property of Queen Essentials or its licensors and is protected under U.S. and international copyright, trademark, and other intellectual property laws.
8.2 You may not copy, reproduce, distribute, publish, display, or create derivative works from the Site or its contents without our prior written consent.

14. Governing Law and Dispute Resolution

14.1 These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to conflict of law principles.
14.2 Any dispute arising from or relating to these Terms or your use of the Site shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) and held in Montgomery County, Alabama.
14.3 Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims involving intellectual property or data misuse.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining Terms shall remain in full force and effect.

16. Termination

We reserve the right to terminate or suspend your account or access to the Site, without prior notice, for any violation of these Terms or conduct that we believe is harmful to us or other users.
